Terms of Service

These Terms of Service (“Terms”) govern access to The Bay mobile application, the authenticated MOC Worldwide website and the related membership, community, event and marketplace services (the “Service”).
The Service is provided by MOC Worldwide OÜ, registry code 17538821, at Harju maakond, Tallinn, Kesklinna linnaosa, Tartu mnt 67/1-13b, 10115, Estonia (“MOC”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how we process personal data.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a contract. Information supplied during registration or a membership application must be accurate and kept current.
Membership is a curated community. We may require an application, referral, review, approval and an active subscription before access is granted. An approval, profile rank, honorary status or preview access is personal, non-transferable and does not give any ownership, employment, agency or governance right in MOC Worldwide OÜ.
2. Accounts and security
You are responsible for activity under your account and for keeping access to your email, phone, device and authenticated website sessions secure. Notify info@mocworldwide.com promptly if you suspect unauthorised use.
You may not sell, transfer, share or impersonate another person’s account. We may require reasonable verification to protect the account or community.
3. Membership access and ranks
The Service may use states such as waitlist, accepted and member, and ranks such as outsider, scout, explorer, navigator and patron. These are product access and community-recognition states. We may adjust them in accordance with the published membership process, subscription status, moderation decisions and community governance features.
Unless MOC expressly grants fee-exempt access, active paid membership is required for member-only features. A patron may receive fee-exempt access, but still requires an active member visibility state. Preview or promotional access may be ended or reset by MOC at any time stated in the promotion.
4. Subscriptions and payment
Apple subscriptions
The iOS app may offer monthly and annual auto-renewable subscriptions through Apple In-App Purchase. The exact price, currency, billing period and any trial are shown in the App Store purchase sheet before confirmation.
Payment is charged to the Apple Account at confirmation. The subscription renews automatically unless cancelled through Apple at least 24 hours before the end of the current period, subject to Apple’s applicable terms. Apple manages payment, renewal, cancellation and refund requests. Deleting The Bay does not cancel an Apple subscription.
Stripe website subscription
The MOC website may offer an annual auto-renewable subscription through Stripe. The checkout page shows the total price, currency, taxes if applicable, billing interval and renewal terms before purchase. Stripe stores and processes the payment method.
The subscription renews each year until cancelled. It can be managed through the authenticated MOC billing page and Stripe customer portal. Unless otherwise required by law, cancellation takes effect at the end of the current paid billing period and does not provide a partial-period refund. Deleting The Bay does not by itself cancel a Stripe subscription.
General billing terms
Do not maintain overlapping Apple and Stripe subscriptions for the same membership. If duplicate subscriptions are created, each provider may continue billing until separately cancelled.
Prices and applicable taxes may change. We or the billing provider will give notice and obtain consent where required. Failure, reversal, expiry, refund or cancellation of payment may suspend member access. Access may remain temporarily available during a provider grace period, but this is not guaranteed.
Nothing in these Terms limits refund, cancellation or consumer rights that cannot lawfully be excluded.
5. EU/EEA withdrawal rights
If you are an EEA consumer, you may have a statutory right to withdraw from a distance contract within 14 days. Where you ask for the membership service to begin immediately, you expressly request performance during that period. If you withdraw after performance has begun, we may charge a proportionate amount for the service supplied where permitted by law.
For an Apple purchase, use Apple’s refund and withdrawal process. For a Stripe purchase, send an unambiguous withdrawal request to info@mocworldwide.com with your account email and purchase date. You may use, but are not required to use, this wording:
I hereby give notice that I withdraw from my contract for MOC Worldwide membership, ordered on [date]. Name: [name]. Account email: [email]. Date: [date].
This section does not reduce any mandatory local consumer protection.
6. Acceptable use and community conduct
You must treat other users respectfully and use the Service lawfully. You must not:
- threaten, harass, bully, stalk, exploit or discriminate against anyone;
- post hate speech, sexual exploitation, non-consensual intimate material, unlawful nudity or content encouraging violence or self-harm;
- impersonate others or publish private or confidential information without authority;
- infringe copyright, trademark, privacy, publicity or other rights;
- send spam, scams, deceptive offers, malware or unauthorised commercial promotions;
- manipulate votes, reviews, referrals, membership decisions, ranks or engagement;
- scrape, reverse engineer, overload, bypass security or access data without permission;
- use the marketplace for prohibited, stolen, counterfeit or unsafe goods;
- use events, location or QR features to endanger, deceive or track another person.
Use the in-app reporting tools for objectionable content, conduct, marketplace issues or harassment. Contact support for urgent safety or legal concerns. Call local emergency services where there is an immediate danger.
We may investigate, remove or restrict content; limit marketplace or community features; suspend access; reverse abusive actions; preserve evidence; and report conduct to authorities where appropriate.
7. User content
You retain ownership of content you create. You grant MOC a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical display, transmit and show that content solely to operate, secure, moderate and improve the Service. The licence lasts for as long as the content is present in the Service and for a reasonable period in backups, legal records or moderated evidence.
You represent that you have the necessary rights to post your content and that it complies with these Terms. Other users’ content belongs to them and may not be reused outside the Service without permission or another lawful basis.
8. Conversations and privacy
Do not assume that messages or member-only content will remain confidential: recipients can copy or disclose what they receive. You must not share another user’s private information or content without permission.
9. Events, meetups and locations
Events, venues, travel indicators and meetup signals may be created by users and may be inaccurate, changed or cancelled. MOC does not guarantee an organiser, attendee, venue, route or event.
Use your own judgement, meet safely, respect venue rules and local law, and do not rely on the Service for emergency assistance. Organisers are responsible for their events, permissions, charges, safety information and compliance.
10. Marketplace
Marketplace listings and deals are made between users. Unless expressly stated, MOC is not the buyer, seller, payment provider, delivery provider, auctioneer or agent and does not take possession of goods.
Users are responsible for verifying counterparties, goods, ownership, condition, price, payment, delivery and legal compliance. Ratings and moderation tools reduce risk but do not guarantee a transaction. We may restrict listings or accounts and assist with reports, but we are not required to mediate or reimburse a user-to-user transaction.
11. Third-party services
The Service interoperates with Apple, Stripe, RevenueCat, Discord, Google Maps/Places and other providers. Their services are governed by their own terms and privacy policies. MOC is not responsible for a third-party outage, account decision or content, but this does not affect obligations MOC cannot exclude by law.
12. Service changes and availability
We may maintain, update, add, remove or discontinue features. We may require an app update for security or compatibility. We do not promise uninterrupted availability and may temporarily restrict access for maintenance, safety, legal or security reasons.
Material changes affecting an active paid subscription will be handled in accordance with applicable law.
13. Suspension and termination
You may stop using the Service and delete your account in the app. Billing subscriptions must be cancelled separately with Apple or through Stripe.
We may warn, suspend or terminate an account for a material or repeated breach, safety risk, fraud, non-payment, legal requirement or serious harm to the community. Where appropriate, we will provide notice and a reasonable opportunity to appeal by contacting support.
Provisions that by their nature should survive termination—including payment obligations, intellectual-property licences for retained legal records, disclaimers, liability and dispute terms—will survive.
14. Disclaimers
The Service provides a community platform and related technical tools. To the maximum extent permitted by law, it is provided “as is” and “as available.” We do not endorse or guarantee user content, users, events, venues, marketplace goods, availability, rankings or outcomes.
Nothing in these Terms excludes statutory guarantees or remedies that apply to consumers.
15. Liability
MOC is liable without limitation where liability cannot lawfully be limited, including for intentional misconduct, gross negligence, fraud, and death or personal injury caused by negligence where applicable.
For other claims, and to the extent permitted by law, MOC is not liable for indirect or unforeseeable loss, lost profit, lost opportunity, or loss caused by another user or a third-party service. For a paid consumer service, any financial cap will not be less than the remedies and minimum liability required by mandatory consumer law.
16. Governing law and disputes
These Terms are governed by Estonian law. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually reside, and you may bring proceedings in any court available under mandatory consumer law.
Please contact info@mocworldwide.com first so we can try to resolve a complaint. Estonian consumers may also contact the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority. EEA consumers may use the dispute-resolution body available in their country.
17. Changes to these Terms
We may update these Terms for legal, security or product reasons. We will publish the new date and provide advance or in-product notice of material changes where required. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
